AdvCake CPA Platform Terms of Use

1.1. These AdvCake CPA Platform Terms of Use (the “Terms”) govern the provision of access to and use of the AdvCake CPA software (the “Platform”) by users.

1.2. The Platform is software designed to automate tasks related to the management, monitoring, analytics and optimization of advertising campaigns and partner programs.

1.3. The Platform is provided as an internet service. Users are not required to install software on their devices in order to use the Platform, unless otherwise expressly provided by the Platform functionality.

1.4. These Terms constitute an agreement between the Platform operator and the user with respect to access to and use of the Platform and govern exclusively the relationship related to the use of the Platform.

1.5. By using the Platform, the user confirms that they have read and accepted these Terms in full.

1.6. If the user does not agree to these Terms, the user must not use the Platform.

2.1. Platform means the AdvCake CPA software, access to which is provided through the Internet.

2.2. User means an individual, individual entrepreneur or legal entity using the Platform.

2.3. Personal Account means a virtual user account maintained on the Platform's servers and accessible after authentication.

2.4. Account means a set of data used to identify the User and provide access to the relevant Platform functionality.

2.5. Webmaster means a User who is provided with a corresponding set of Platform functionality for working with partner programs and advertising tools.

2.6. Advertiser means a User who is provided with a corresponding set of Platform functionality for managing and analyzing advertising campaigns.

2.7. Administrator means a person responsible for administering the Platform and managing its functionality.

2.8. Other terms used in the Platform may have the meaning assigned to them by the Platform interface and technical documentation.

3.1. The User is provided with access to the Platform in accordance with the role assigned to the User and the functionality available to the User.

3.3. The specific set of functions available to a User depends on the User's role, Account settings and the technical capabilities of the Platform.

3.4. The Operator may modify, supplement or improve the functionality of the Platform, including introducing new functions and discontinuing individual functions.

4.1. Registration may be required to access certain Platform functions.

4.2. When registering, the User must provide accurate, current and complete information.

4.3. The User is responsible for maintaining the confidentiality of their Account credentials and must not disclose them to third parties, except where such disclosure is permitted by the Platform functionality.

4.4. All actions performed using the User's Account shall be deemed to have been performed by the relevant User unless the User proves otherwise.

4.5. If the User becomes aware of unauthorized access to their Account, the User must promptly notify the Platform Operator.

4.6. The Operator may request additional information necessary to ensure Platform security, identify the User or provide the relevant functionality.

5.1. The User must use the Platform in compliance with applicable law, these Terms and the Platform's technical requirements.

5.3. The User is responsible for actions performed using the User's Account.

6.1. The Personal Account is used to provide the User with access to Platform functionality and to exchange information.

6.2. Information posted in the Personal Account may be used to notify the User about the operation of the Platform, changes to its functionality, technical matters and other issues related to the use of the Platform.

6.3. The User is responsible for monitoring information posted in the Personal Account.

6.4. Where the Platform functionality provides for notifications to the User's email address, such notifications may be used to inform the User about events related to the User's Account and use of the Platform.

7.1. Where available, the User may access the Platform through the API.

7.2. The API must be used in accordance with the applicable technical documentation and limitations established by the Platform.

7.3. The User is responsible for maintaining the confidentiality of API keys and other authentication credentials.

7.4. The Operator may restrict or suspend API access in the event of security violations, excessive load or use of the API in a manner that threatens the stability of the Platform.

8.1. The Platform may generate statistical and analytical data based on information received by the Platform.

8.2. Statistical and analytical data are provided through the Platform functionality and may be used by the User for monitoring and analysis purposes.

8.3. The User is solely responsible for determining whether the data obtained through the Platform are suitable for the User's purposes.

8.4. The Operator does not guarantee that statistical and analytical data will be absolutely complete, uninterrupted or free from technical errors.

9.1. The Platform may use technical means to monitor its proper operation and detect signs of improper or unauthorized use.

9.2. Such means may include analysis of technical interaction parameters, session information, URL parameters, technical identifiers, browser data and other technical data necessary for the operation of the relevant functionality.

9.3. The Operator may implement technical and organizational measures to protect the Platform, its Users and data against unauthorized access and other security threats.

10.1. Users' personal data are processed in accordance with applicable law and the Privacy Policy available on the Platform.

10.2. The Platform may use cookies and similar technologies necessary for the operation of the Platform, security, authentication, analytics and improvement of the service.

10.3. The processing of personal data and the use of cookies are governed by the Operator's relevant policies and documents.

11.1. All exclusive rights to the Platform, its software code, databases, interface elements, design, documentation and other protected intellectual property belong to the Platform Operator or other applicable right holders.

11.2. Providing the User with access to the Platform does not transfer any exclusive rights to the Platform or any of its elements to the User.

11.3. The User is granted a limited right to use the Platform functionality solely to the extent necessary to use the Platform in accordance with these Terms.

11.4. The User must not copy, modify, decompile, disassemble or otherwise reverse engineer the Platform for the purpose of obtaining its source code, except to the extent expressly permitted by applicable law.

12.1. Where the Platform functionality allows the User to upload information, files or other materials, the User is solely responsible for the lawfulness of their use and provision through the Platform.

12.2. The User represents that they have all necessary rights and legal grounds to upload or otherwise provide such materials.

12.3. The Operator may remove or restrict access to materials whose placement violates applicable law or these Terms or creates a security risk to the Platform.

13.1. The Operator takes reasonable measures to maintain the operation of the Platform but does not guarantee uninterrupted or error-free operation.

13.2. Access to the Platform may be temporarily restricted due to maintenance, software updates, troubleshooting, information security measures or other technical reasons.

13.3. The Operator may modify the technical specifications, interface and functionality of the Platform.

14.1. The Platform may interact with third-party information systems and services.

14.2. The Operator is not responsible for the content, availability, operation or results of third-party services that are not controlled by the Operator.

14.3. The use of third-party services may be subject to separate terms imposed by the respective service providers.

15.1. The User is responsible for complying with these Terms and applicable law when using the Platform.

15.2. The User is responsible for the security of their Account credentials and for any consequences resulting from disclosure of such credentials to third parties.

15.3. The Operator is not liable for the User's inability to access or use the Platform due to circumstances beyond the Operator's reasonable control.

15.4. The Operator is not liable for losses resulting from the User's improper use of the Platform, violation of these Terms or failure to comply with security requirements.

15.5. In all cases, the Operator's liability shall be determined subject to the limitations established by applicable law.

16.2. Where technically possible, the Operator may notify the User in advance of an access restriction, except where immediate restriction is necessary to protect security or comply with applicable law.

16.3. Termination of access to the Platform does not release the User from obligations that arose before termination.

17.1. The Operator may amend these Terms.

17.2. The amended Terms shall become effective upon publication on the Platform unless another effective date is specified in the amended version.

17.3. Continued use of the Platform after the amended Terms become effective constitutes the User's acceptance of the amended Terms.

17.4. If the User does not agree with the amendments, the User must stop using the Platform.

18.1. Users may contact support through the ticketing system, chat or other channels provided by the Platform Operator.

18.2. When contacting support, the User shall provide information reasonably necessary to identify and resolve the issue.

18.3. The Operator may request additional information, screenshots, files or other materials necessary to process the User's request.

19.1. These Terms are governed by the laws of the Russian Federation.

19.2. Any disputes or disagreements shall first be resolved through negotiations.

19.3. If a dispute cannot be resolved through negotiations, it shall be resolved in accordance with the applicable laws of the Russian Federation.

20.1. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20.2. These Terms shall apply to the User from the moment of acceptance until the User ceases to use the Platform or the Terms cease to apply to the relevant User.

20.3. Matters not covered by these Terms shall be governed by applicable law of the Russian Federation.

20.4. Where separate Operator documents govern specific aspects of the use of the Platform, such documents shall apply to the relevant aspects.
